Welcome to the Terms of Service (“Terms”) of MathMarketing Pty Ltd (ACN 067 392 394) ATF MathMarketing Unit Trust (“align.me”).

Application of Terms

These Terms apply to all uses of Funnel Plan (funnelplan.com), our company website (www.align.me), and our services (together “Funnel Plan”). By using Funnel Plan and these other properties, you acknowledge that you have read and understand and agree to be bound by these Terms.

We reserve the right to change these Terms at any time without notice. Any change in these Terms will apply from your next use of Funnel Plan. If the change is material, we’ll let you know by alerts or direct communication before they take effect.

If you breach any of these Terms, align.me may automatically deactivate your account.

Account

You are responsible for providing your correct and full personal details to align.me. We grant you the rights to access and use Funnel Plan whilst your account is valid. It’s up to you to maintain the privacy and security of your account and personal log-in details. You agree to not provide others with access to your account for Funnel Plan.

Fees

You must pay us the fees (if any) applicable to the subscription level of Funnel Plan you access. If you have subscribed to a paid plan, you will be charged a monthly or annual fee applicable to that subscription package. You hereby authorise us to automatically deduct the applicable fees, using your nominated payment method, in advance at the start of each month or year as applicable.

We don’t provide refunds or credits if you don’t use or decide to cancel your paid subscription to Funnel Plan during the pre-paid month.

If we agree to charge you by invoice rather than credit card, we’ll specify the payment terms up front and you agree to pay within the terms of any invoice. If any overdue amount owed by you is not paid within ten (10) days of its due date, then in addition to any other amount due, you agree to pay late payment charges at the rate of 2% greater than the then-current rate fixed under Section 2 of the Penalty Interest Rates Act 1983 (Vic) on any amount outstanding, from the due date until the date of payment. And if we have to bring in the heavies (debt collection), then you will also be responsible for our costs associated with such debt collection.

Modification and Suspension

We want Funnel Plan to live forever. But we have to reserve the right to modify, suspend, or discontinue Funnel Plan at any time for any reason with or without notice. If we do suspend or discontinue, we’ll credit you for any significant period of discontinuation. We also reserve the right to change our fees by 30 days notice to you.

Termination and Cancellation

You can cancel your subscription at any time by 7 days notice to us. Just contact us at support@funnelplan.com and we’ll get it sorted. We’ll move any of the Funnel Plans in your account to ‘parked’. This means we’ll keep the data for you, and you will be able to print those plans but you won’t be able to modify them. We can ‘unpark’ plans on your request (i.e. if you change your mind down the track) for a fee. You will still be a subscriber even if you have no paid plans associated with your account.

Termination is a whole other ball game. We may immediately terminate your account for any breach of these Terms by you. If we plan to cease offering Funnel Plan, we’ll give you 30 days notice and then terminate your account.

If your account is terminated by you or by us, that’s it! You agree to not seek to access Funnel Plan and that you have no right to refund of the whole or part of any fees paid. You are responsible for any fees accrued to your account up to the time of deactivation, cancellation, or termination including full monthly charges for the month in which such event occurs.

Usage and Data

You consent to us monitoring and keeping records of your use of Funnel Plan and to using any usage data to shape advice we may give from time to time. You understand and agree that we will collect, retain and use de-identified data provided from your use of Funnel Plan to inform reporting and coaching for you and for others. To be clear, we’re not allowed to share your specific plans with anyone. Only you explicitly add coaches, collaborators and viewers to your own specific plans. But the de-identified data in other plans is critical to us giving you directional advice about ways to improve your plans, and your de-identified data will be used by us to serve the same role for others.

In addition to de-identifying any data, when we use data to report or give advice to you and to others, we use averages from pools of plans rather than any individual plan to prevent reverse engineering of their or your data.

Reservations, Ownership and Restrictions

WE RESERVE ALL RIGHTS NOT EXPRESSLY GRANTED TO YOU IN THESE TERMS. FUNNEL PLAN IS PROTECTED BY COPYRIGHT AND OTHER INTELLECTUAL PROPERTY LAWS AND TREATIES. align.me OWNS THE TITLE, COPYRIGHT, AND OTHER INTELLECTUAL PROPERTY RIGHTS IN FUNNEL PLAN.

You may not reverse engineer, decompile, decode, decrypt, disassemble, copy, rent, lease, lend, sublicense, time-share, distribute, sell, assign, create derivative works of or otherwise transfer these rights or Funnel Plan. You may not distribute any of the images or materials comprised in Funnel Plan, but may distribute the PDF plan using the plan printing feature within Funnel Plan.

General Conditions

Your use of Funnel Plan, including any content, information or functionality contained within it, is provided ‘as is’ and ‘as available’. To the extent permitted by applicable law, align.me and its suppliers do not and cannot warrant the performance, results or any model that you may obtain using Funnel Plan. align.me and its suppliers make no warranty of any kind, express or implied, including without limitation, any warranties of merchantability and/or fitness for a particular purpose. You assume total responsibility and risk for your use of Funnel Plan.

align.me makes no warranties regarding your ability to use Funnel Plan, your satisfaction with Funnel Plan, that Funnel Plan will be available at all times, uninterrupted, and error-free, the accuracy of mathematical calculations performed by Funnel Plan, and that bugs or errors in Funnel Plan will be corrected.

In no event will align.me’s liability for any damages ever exceed the actual fees paid by you for Funnel Plan. To the full extent permissible by law, neither align.me nor its suppliers shall be liable for any direct, indirect, consequential, incidental, exemplary, punitive or special damages, including interoperability issues, data loss, lost profits, lost savings or other incidental or consequential damages arising out of the use of or inability to use Funnel Plan, even if align.me and its suppliers have been advised of the possibility of such damages. Your sole remedy for dissatisfaction with Funnel Plan is to stop using Funnel Plan.

These Terms and any dispute under it will be governed by the laws of Victoria, Australia, without regard to their conflict of laws principles. Both parties consent to the exclusive jurisdiction and venue of the federal and state courts in Australia.

These Terms constitutes the entire agreement between you and align.me with respect to its subject matter, and supersedes other communication, advertisement, or understanding with respect to Funnel Plan. If any provision of these Terms is held invalid or unenforceable, the remainder shall continue in full force and effect. All provisions of these Terms relating to disclaimers of warranties, limitation of liability, remedies, or damages, and align.me’s ownership of Funnel Plan survive termination.

align.me recognises the importance of privacy protection. Our Privacy Policy outlines our open management of your personal information, in accordance with the Australian Privacy Principles (‘APPs’).

This Privacy Policy applies to any personal information provided in your use of the Website and dealings with us. This Privacy Policy is part of our Website Terms and Conditions available at Terms of Service.

Part 1 of the Privacy Policy sets out the general guidelines that our employees, volunteers, and agents follow in relation to your personal information and privacy protection. Part 2 of the Policy outlines specific processes relating to our various modes of data collection.

Part 1

In short, we collect any information that you voluntarily give to us. This includes the information you provide in filling out an online enquiry form, in creating a wiki user profile, in subscribing to Funnel Vision, or in attending workshops including Funnel Academy, Funnel Camp and Funnel Mastery. We also collect information in the form of referrals by site users to third parties. We will never sell your information to a third party, will only use it for the purpose disclosed, and will store it in a secure location.

General Guidelines

If we hold personal information about you, we will provide you with access to that personal information in accordance with all applicable legal requirements.

Personal information includes information of a personal nature which either specifically identifies you or from which your identity can reasonably be ascertained.

Disclosure to overseas recipients

We will not, in our normal operations, disclose your personal information to overseas recipients. If we intend to do so for any purpose other than in response to a subpoena or other compulsory request by law enforcement, we will contact you for consent.

Data breach

In the unlikely case that we ever experience a serious data breach, we will give notice to you and the Office of the Australian Information Commissioner of the following:

  • Your identity and contact details;
  • A description of the serious data breach;
  • The kind(s) of information concerned; and
  • Recommendations about the steps you should take in response.

Please note that we are not required by law to notify you of the steps we will take to remedy the breach, nor are we legally obligated to provide assistance.

How we collect and hold personal information

We collect and hold information in the instances outlined in Part 2, or where otherwise voluntarily provided to us by you.

For any of the following purposes, you are welcome to contact us using the contact form on this page and we will respond promptly:

  • For clarification on any aspect of our Privacy Policy
  • To unsubscribe from any direct marketing campaigns
  • To request access to your personal information for the purposes of checking accuracy and / or making corrections
  • To complain if you believe that we are in breach of the APPs with regard to your personal information
What is a privacy complaint?

A privacy complaint relates to any concern that a person may have regarding our privacy practices or our handling of your personal information. This could include matters such as:

  • How your personal information is collected or stored;
  • How your personal information is used or disclosed; and
  • How access is provided to your personal information.
Who may make a complaint?

If you have provided us with personal information or we have collected and hold your personal information, you may make a complaint, have it investigated and dealt with under this policy.

Complaints resolution procedure

Once the complaint has been lodged, we will try to resolve the matter in a timely fashion as follows:

  • You should receive acknowledgement of receipt of your complaint within 14 days of the date you lodge it.
  • We may request further information from you. This will enable us to investigate the complaint and determine an appropriate solution. All details provided will be kept confidential.
  • It may be necessary to contact others in order to proceed with the investigation. This may be necessary in order to progress your complaint.
  • If your complaint involves the conduct of our employees we will raise the matter with the employee concerned and seek their comment and input in the resolution of the complaint.
  • If your complaint is not able to be resolved at a local level it will be referred to our legal advisers. You will be notified if this happens.
  • You will be informed of the outcome of the investigation, the action taken to resolve the issue and the changes made to prevent this matter recurring.
  • If the Privacy Officer determines, either before or after an investigation, that the complaint is not well-founded, the Privacy Officer will inform the complainant in writing of this decision and the reasons for it.
  • If the complaint is not resolved to your satisfaction, you are entitled to refer your complaint to the appropriate Privacy Commissioner.

We will keep a record of your complaint and the outcome.

Part 2

Inbound Enquiries

We receive inbound enquires via our online contact form and phone. If you contact us this way, we may require your full name, role, organisation, telephone number, and email address in order to facilitate business communication with you.

Website

The type of personal information that we collect from you will depend on how you use our website.

In general, we look at the number of hits our site receives and keep track of the domains from which the site is accessed. To determine what users are interested in, we may also look at the top 20 search words used in connecting users to the site.

Regarding your personal usage, we use cookies so that we can recognize you as a unique user of our site. These cookies are readable only by us, and cannot access, read, or modify data on your computer. The “Help” section within your toolbar should tell you how you can disable cookies on your computer if you wish to. We recommend, however, that you leave cookies enabled otherwise you will be required to re-enter your personal information each time you visit our site and complete an online form.

From our website, you can access Funnel Wiki; a collaborative forum that aims to empower the global B2B community to share, capture, and develop the world’s best B2B knowledge.

By its nature, Funnel Wiki is collaboratively developed by our employees and external users using MediaWiki software. To edit existing pages or create new pages on Funnel Wiki, you must create a user profile, which requires you to supply your email address and create a username. We will store your email address safely, and we will not share it or sell it to anyone.

Editing or creating content on the wiki is a public act, and you will be identified publicly by your username. By doing this, you create a published document, and a public record of every word added, subtracted, or changed; including the date and time that this took place. All your contributions are irrevocably licensed and may be freely copied, reused, and adapted by us or other third parties with few restrictions.

By using the Website, you consent to the collection and use of this information by us. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it.

We will not be liable for any disclosure of your personal information to any third party not authorised under these terms which may result from circumstances beyond our reasonable control. We take no responsibility for the privacy and security of the above information after you have “hyperlinked” to another website.

Funnel Vision

Funnel Vision is a series of easily digestible marketing tips sent for free, via email, once a month. You may subscribe to Funnel Vision by signing up via our website, which requires your first name, last name, and email address. If you wish, you may use a pseudonym but should note that this will impede our ability to contact you should you make such a request. You may also subscribe to the Funnel Vision blog, which doesn’t require you to provide any personal information.

You may be subscribed to Funnel Vision by us in the following contexts:

  • If we have an existing relationship with you;
  • If you attend Funnel Camp or Funnel Academy; or
  • If you offer your business card or contact details to us (eg. at a networking event).

In all cases, a clearly visible and effective ‘Unsubscribe’ link is included in all Funnel Vision emails.

Funnel Coaches

If we receive your contact details from one of our Funnel Coaches, we will store them. Funnel Coaches may be located overseas, however, any information we receive is processed in compliance with the APPs.

Delivery

If you attend Funnel Camp and Funnel Academy, and if you are a user of Funnel Plan, we will store your contact details.

Direct marketing

For the purposes of direct marketing, we may receive (and then store) your contact details via:

  • Online subscription forms; and
  • Credentialed list brokers.

All direct marketing is done in accordance with the Australian Spam Act.

Networking

If you willingly provide your contact details at networking events, we will store them.

Referrals

If you are referred to us via an existing contact, client, or colleague, we will store your contact details.

Funnel Plan & Google Sheets

Site Admins and Funnel Coaches of Funnel Plan have to option to produce a project plan to manage the execution of plans to which they have been granted access. By signing in on your google account, you’re authorizing Funnel Plan to access your Google Drive where the output (in form of Google Sheets) will be saved. Funnel Plan will not read, modify or delete any of your files. Funnel Plan will only access the project plan outputs and nothing else. In addition, we do not store any of your Google user data. Logging in on to your Google account is only to authenticate your Google account.
